BY USING OUR SERVICE OR INDICATING THAT YOU ACCEPT THESE TERMS AND CONDITIONS, YOU ARE BOUND BY THE TERMS OF THIS AGREEMENT. YOU CANNOT USE OUR SERVICES IF YOU DO NOT AGREE TO THESE TERMS.
The ApplyAI reserves the right to alter these Terms at any time. The Company will make a reasonable attempt to serve prior notice of changes to the Terms. By using the Service after changes to the Terms, you are agreeing to be bound by the updated Agreement.
AS OUTLINED HEREUNDER, THESE PROVISIONS GOVERN THE UTILIZATION OF ARBITRATION ON AN INDIVIDUAL LEVEL FOR DISPUTE RESOLUTION, PRECLUDING RECOURSE TO JURY TRIALS OR CLASS ACTIONS, AND RESTRICTING THE AVAILABLE REMEDIES IN THE EVENT OF A DISPUTE. THE OPTION TO REFRAIN FROM ENTERING INTO THIS ARBITRATION AGREEMENT IS AVAILABLE BY REACHING OUT TO CONTACT@THEAPPLY.AI WITHIN 30 DAYS OF INITIALLY ACCEPTING THESE TERMS. IN SUCH COMMUNICATION, YOU MUST SPECIFY YOUR FIRST AND LAST NAME AND EXPLICITLY EXPRESS YOUR REFUSAL TO BE BOUND BY THIS ARBITRATION AGREEMENT.
Service.
The "Service" encompasses The ApplyAI's career services and tools designed to facilitate a User’s job hunt or career advancement activities. The Service may undergo periodic updates, relocations, or other modifications, including all networks; downloadable software; mobile, desktop, or web applications; and all associated intellectual property. Any individual, whether acting on their own behalf or representing a third party, engaging with or utilizing the Service is identified as a "The ApplyAI User” (“User”, “you”)
License.
Contingent upon your adherence to these Terms, The ApplyAI hereby confers a non-exclusive, revocable, and non-transferable license, enabling you to access and employ the Service for personal purposes. The Service, unless expressly stated otherwise in writing, is intended solely for personal use and is not intended for resale. The ApplyAI retains the ongoing right, without prior notice, to: (1) limit and/or terminate your access to the Service (or any part thereof); and (2) alter or cease the provision of the Service (or any part thereof).
Equipment.
The utilization of the Service necessitates the use of telecommunications services; The ApplyAI Users will access the Service on their individual desktop, tablet, or mobile devices (hereinafter referred to as the "Equipment," encompassing both hardware and software) or devices they are authorized to use. The ApplyAI will not provide this Equipment to Users and any performance issues attributable to the Equipment are beyond its responsibility. Your obligation encompasses both the payment for the Equipment and ensuring its functionality. Furthermore, you bear sole responsibility for covering all pertinent fees associated with the internet or cellular service utilized in connection with the Service, including but not limited to voice, data, SMS, MMS, roaming, and other applicable charges imposed by your carrier.
Termination of access.
The ApplyAI retains the right, at its discretion and without prior notice to you: (1) to limit, deactivate, and/or terminate your access to the Service (or any part thereof); or (2) to terminate or alter the Service (or any part thereof). The ApplyAI assumes no liability to you or any third party for any termination or modification of the Service, irrespective of the grounds for such termination or modification. In the event of dissatisfaction with any termination or modification of the Service, your exclusive recourse is to cease using the Service.
Privacy Policy.
We care about data privacy and security. By using the Service, you agree to be bound by our Privacy Policy posted on the Service, which is incorporated into these Terms. Please be advised the Service are hosted in the United States. If you access the Service from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United States, then through your continued use of the Service, you are transferring your data to the United States, and you expressly consent to have your data transferred to and processed in the United States.
Subcontractors.
The ApplyAI reserves the right to engage subcontractors or enlist other third parties to fulfill its responsibilities under these Terms. The ApplyAI remains solely responsible for the fulfillment of said responsibilities.
User Registration.
The ApplyAI may require the completion of a registration process to access the Service. Your registration must include up-to-date, comprehensive, and accurate information as required by the registration form.
User Representations.
By using the Service, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Service through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Service for any illegal or unauthorized purpose; and (7) your use of the Service will not violate any applicable law or regulation. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
Eligibility
The ApplyAI requires that a User is at least 18 years of age. By agreeing to these Terms, you warrant that your age is 18 years or older. The ApplyAI reserves the right to terminate Service without prior notice for Users under this age limit.
User Login Credentials
You may be required to register to use the Service. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
It is solely your duty to maintain the security and confidentiality of your login credentials. You commit to promptly inform The ApplyAI (contact@theapply.ai) of any unauthorized use of your account or any security breach. Sharing your login credentials with any third party is strictly prohibited. You bear responsibility for all activities undertaken through your account on the Service, including all user-submitted content.
The ApplyAI assumes no responsibility for any losses incurred due to the unauthorized use of your login credentials or account by others. You may be held accountable for losses suffered by The ApplyAI or a third party resulting from the utilization of your account or login credentials by unauthorized parties.
